The spill or discharge of waste to the ground can trigger a number of regulatory programs including: the Clean Water Act (NPDES, AZPDES, 404); RCRA; CERCLA; as well as programs like the Aquifer Protection Permit program and WQARF.
The Pit-Falls: The greatest challenge when addressing a spill on land is to determine which regulations apply. Most important is the determination whether the waste is hazardous or not. Some regulations even have notice provisions that require notice to the government within a short period of time.
